Terms of Service

The agreement between you and FamPin when you use the app. Please read it, especially the parts on consent and subscriptions.

This agreement

These terms are an agreement between you and [legal name of the business or developer] (“FamPin”, “we”, “us”). They cover the FamPin app for iPhone and iPad and the fampin.com website (together, “the service”). By using the service you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use FamPin.

Who can use FamPin

  • You must be at least 13 to create an account. If you’re under 18, you need permission from a parent or guardian, and they agree to these terms for you.
  • You’re responsible for your account and for what happens in it. Keep your sign-in details safe, and tell us if you think someone else has used your account.
  • Give accurate information when you sign up.

FamPin is for sharing locations between people who have agreed to it. When you use FamPin, you agree that you will:

  • only invite people who know they are joining a location-sharing circle and agree to it
  • never install or use FamPin on someone else’s device to track them without their knowledge and consent
  • only set up FamPin for a child or teen if you are their parent or legal guardian
  • never use FamPin to stalk, harass, threaten, monitor or harm anyone
  • never mark a device as lost to frighten or disturb its owner
  • follow all laws that apply to you, including laws on privacy and surveillance
  • not copy, reverse engineer, overload or interfere with the service, or try to reach data you aren’t allowed to see

We may suspend or close accounts that break these rules, and we may report serious misuse to the authorities.

Not an emergency service

FamPin is not an emergency or safety-monitoring service, and it can’t contact emergency services for you. Locations, alerts and battery levels can be late, inaccurate or missing. This can happen because of GPS or network signal, battery saving, iOS settings, permissions, Ghost Mode, or service outages. Don’t rely on FamPin when someone’s safety is at risk. In an emergency, call your local emergency number.

Free plan and Premium

FamPin is free to start. The free plan includes 1 circle, up to 5 members and 3 saved places. Premium removes these limits. It’s available as:

  • Monthly: US$5.99 a month, with a 7-day free trial for eligible new subscribers.
  • Lifetime: a one-time payment of US$19.99, with no subscription.

Prices may differ by country and are shown in your currency in the App Store before you buy.

  • Payment is charged to your Apple ID account when you confirm the purchase. For the monthly plan, this happens when your free trial ends.
  • The monthly subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the next month within the 24 hours before the current period ends.
  • You can manage or cancel your subscription in your Apple ID account settings. To cancel a free trial without being charged, cancel at least 24 hours before it ends.
  • Deleting FamPin or your account doesn’t cancel a subscription.
  • Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
  • Lifetime access lasts for as long as we offer FamPin, and is tied to the Apple ID you bought it with. Use Restore on the paywall to restore it on another device.
  • If we change subscription prices, Apple will tell you in advance, as its rules require.

Your content

You own what you add to FamPin, such as your name, photo, circle names and places. You give us permission to store, process and show it to the people you share with, only to run the service. You’re responsible for having the right to share what you add.

Privacy

Our Privacy Policy explains what information we collect and how we use it. It’s part of these terms.

Other services

FamPin uses services from other companies, such as Apple Maps for maps and directions, and Google Firebase to run our servers. Their own terms may apply when you use them, and we aren’t responsible for them.

Apple terms

If you downloaded FamPin from the App Store:

  • These terms are between you and us, not Apple. We, not Apple, are responsible for FamPin and its content.
  • Your licence to use FamPin is a non-transferable licence to use it on Apple devices you own or control, as allowed by the App Store Terms of Service.
  • Apple has no obligation to provide maintenance or support for FamPin.
  • If FamPin doesn’t conform to any warranty that applies, you can tell Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for FamPin.
  • We, not Apple, are responsible for handling any claims about FamPin, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection claims.
  • If anyone claims that FamPin infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and resolving that claim.
  • You confirm that you aren’t located in a country subject to a US government embargo or designated as supporting terrorism, and that you aren’t on any US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Disclaimers

We work hard to keep FamPin reliable, but the service is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the service will be uninterrupted, error-free or always accurate.

Limits on liability

To the extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of FamPin. Our total liability for any claim about the service is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50.

Some places don’t allow these limits, so they may not apply to you. Nothing in these terms limits rights you have under consumer law that can’t be waived.

You agree to cover our reasonable costs if a claim is brought against us because you misused FamPin or broke these terms, for example by tracking someone without their consent.

Ending this agreement

You can stop using FamPin and delete your account at any time. See Delete your account. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering FamPin. If we stop offering FamPin, we’ll give reasonable notice where we can.

Changes to these terms

We may update these terms as FamPin changes. We’ll update the date at the top, and tell you in the app or by email before a significant change takes effect. If you keep using FamPin after that, you accept the new terms.

Governing law

These terms are governed by the laws of [state or country], without regard to its conflict-of-law rules. Disputes will be heard in the courts of [city, state or country], unless the consumer law where you live gives you the right to bring a claim in your local courts.
